This notice provides additional privacy information for:

Members of the public making an insurance claim for loss against the Council

Purposes

We collect, or obtain your personal information for the following purpose(s):

  • To enable us to process insurance claims made to the Council
  • To enable us to data match claims, transactions and payments to be identified as part of the Cabinet Office’s NFI (National Fraud Initiative) to assist in the prevention and/or detection of fraud.

In order to carry out these purposes we collect and obtain:

  • Name
  • Address
  • National Insurance Number
  • Occupation
  • Date of Birth
  • Medical Records 

Legal basis for processing

The legal basis for processing your personal information is:  

  • Limitation Act 1980
  • Latent Damage Act 1986

Information sharing/recipients

We may share personal information about you with the following types of organisations:

  • Cabinet Office – Under the National Fraud Initiative (NFI)
  • Department for Work and Pensions
  • Other Local Authorities
  • HM Revenues and Customs
  • Police
  • Utility Companies
  • Credit reference agencies
  • Service providers / Contractors / Partner bodies

As well as information collected directly from you, we also obtain or receive information from:

  • Members of public / witnesses where applicable
  • Social media where applicable

For this service:

  • All the decisions we make about you involve human intervention

Data retention/criteria 

We usually retain your information for 6 year plus the current year, although it may need to be retained for the current year plus 15 years for negligence claims not involving personal injuries.
