Our core data protection obligations and commitments are set out in the Council’s primary privacy notice.

This notice provides additional privacy information for

  • Business Operators
  • Employees
  • Members of the Public (Complainants)

of the following Trafford Council services: 

  • Environmental Health
  • Environmental Protection
  • Housing Enforcement

Purpose(s)

Regulatory Services are responsible for regulation of environmental health matters in the Borough.

Environmental health includes environmental protection, statutory nuisance, private tenanted property, food hygiene, infectious diseases, food poisoning outbreaks, health & safety in accordance with their remit.

The main purposes for processing your personal information are: 

  • Investigation of complaints or responding to enquiries 
  • Pro-active enforcement activities to ensure compliance
  • For the prevention and / or detection of fraud and / or crime
  • Intelligence sharing with enforcement partners
  • To allow us to communicate with service users
  • To fulfil a legal obligation

Body worn video cameras

Body worn video cameras will assist in the investigation of anti-social behaviour and environmental crime and will therefore capture:

  • Victims of crime
  • Persons suspected of committing offences
  • Witnesses of crimes.

In addition, persons, unrelated to any specific interaction between council officers and any of the categories of individuals named above, may find their activities captured on a body worn video. To some degree, this is inevitable since a camera lens or microphone is non-discriminatory and captures what is seen or heard. A Data Protection Impact Assessment has been completed regarding the use of body worn video cameras.

Body worn videos will not be routinely recording or monitoring on a continuous basis and will only be switched on when an incident is occurring or is suspected to occur.

Categories of personal data

In order to carry out these purposes we collect and obtain:

  • Personal contact details such as name, title, addresses, telephone numbers, and personal email addresses
  • Personal demographics (including date of birth, gender, marital status)
  • Contact details such as names, addresses, personal e-mail address, telephone numbers 
  • Bank account details, payroll and tax/national insurance status information..

We may also collect, store and use the following "special categories" of more sensitive personal information:

  • Offences (including alleged offences), criminal proceedings, outcomes and sentences 

Sources if not obtained from data subject 

As well as information collected directly from you, we also obtain or receive information from:

  • Your representatives – where you have instructed a representative to submit a service request on your behalf e.g. local councillor, MP, friend/family member
  • Health information from your employer (relating to a reportable accident in the workplace) and the Health & Safety Executive
  • Health information (relating to an infectious disease) from Public Health England
  • Financial information (relating to a Trading Standards issue) from Citizens’ Advice

Legal basis for processing

The legal basis for processing your personal information is:

  • Local Government Act 2000
  • Public Health Acts
  • The Housing act and associated legislation
  • The Health and Safety at Work etc. Act 1974 and associated Regulations.
  • The Food Safety Act 1990
  • Environmental Protection Legislation

The processing of “Special category” information is provided by Article 9(2)(g) of the General Data Protection Regulation – that the processing is necessary due to reasons of substantial public interest.

Consequences if information is not provided

If you do not provide consent, we may not be able to perform the contract we have entered into with you such as the regulation of an environmental health issue, or we may be prevented from complying with our legal obligations such as to assess compliance with environmental health matters.

  • Coroner Office
  • Public Health England
  • Health Protection Agency
  • HM Revenue and Customs
  • Local Government Ombudsman
  • Information Commissioner’s Office
  • Other Organisations (where the disclosure is necessary for the purposes of the prevention and / or detection of crime)

We also collect or receive information from external parties such as:

There may be certain circumstances where we would share without consent such as when we are required to do so by law for reasons of public safety, where someone is at risk of harm or in emergency situations. Only the minimum information for the purpose will be shared.

Automated decisions

All the decisions we make about you involve human intervention and are not automated.

Data retention/criteria 

We will only keep your personal information for as long as the law specifies or where the law does not specify this, for the length of time determined by our business requirements.
