Statement of Licensing Policy on the Handling of Disclosure Information
• Trafford will ensure that Disclosure information is not passed to persons not authorised to receive it under section 124 of the Police Act 1997; • Trafford will ensure that Disclosures and the information they contain are available only to those who need to have access in the course of their duties; • Trafford will securely store Disclosures and the information they contain; • Trafford will neither retain Disclosures nor a record of Disclosure information contained within them for longer than is required for the particular purpose. In general, this will be no later than six months after the date on which the relevant decision has been taken, or after the date on which any dispute about the accuracy of the Disclosure information has been resolved. This period will be exceeded only in very exceptional circumstances which justify retention for a longer period. This statement is made in accordance with the ‘Code of Practice and Explanatory Guide for Registered Persons and other recipients of Disclosure Information’ published by the Criminal Records Bureau. A copy of the Code of Practice is available on request from Trafford Council’s Licensing Office. 1a. To be a licensed Hackney or Private Hire driver with us you must have a current DBS Enhanced Certificate and you must also subscribe to the DBS Update Service. By subscribing to the DBS Update Service status checks can be carried out at least every six months, in line with the DfT Statutory Standards. To do this we must have your consent. If you do not give consent, or remain subscribed to the update service, then you will have to obtain a new DBS certificate and provide a copy to us every 6 months. If you fail to do this then you are at risk of having your driving license suspended, reviewed, and ultimately revoked. You must read the Enhanced Check Privacy Policy for applicants as it explains how DBS will process your personal data and the options available to you for submitting an application. 1. Confirm you have read the privacy policy and understand how your data will be processed. I consent. 2. Tick one of the boxes. Right to Work
If you do not hold a UK Passport, or a UK birth certificate, you must have a current valid passport from your country of origin and your biometric residency permit and/or proof that you have the right to work and remain in the UK. For all EU Passport Holders, you must now submit both a copy of your EU Passport and proof of pre-settled status. Visas in expired passports cannot be accepted. It is for you to prove you have the right to work and remain in the UK. Additional information may be requested by the Licensing Officer in relation to this matter. If there are restrictions on the length of time you may work in the UK, your licence will not be issued for any longer than this period. In such circumstances, the check will be repeated each time you apply to renew or extend your licence. If, during this period, you are disqualified from holding a licence because you have not complied with the UK’s immigration laws, your licence will lapse and you must return it to the Licensing Authority, failure to do so is a criminal offence.

Should you fail to declare any convictions, cautions, arrests, restorative justice or any other disposals, fixed penalty or non-conviction this includes motoring offences, when completing this form, you may be prosecuted by the Council. Trafford Council can refuse, suspend or revoke a licence based on incorrect or incomplete information provided in your application. Do not be tempted to omit any information because you are not sure if it must be declared or not, the Council will make this assessment and disregard anything deemed irrelevant. National Register of Taxi Driver Refusals and Revocations
The licensing authority provides information to the National Register of Taxi Licence Refusals and Revocations (NR3), a mechanism for licensing authorities to share details of individuals who have had a hackney carriage or Private Hire Vehicle (PHV) licence revoked, or an application for one refused. This is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the licensing authority – that is, assessing whether an individual is a fit and proper person to hold a hackney carriage or PHV licence
Therefore:  Where a hackney carriage/ PHV licence is revoked, or an application for one refused, the authority will automatically record this decision on NR3.  All applications for a new licence or licence renewal will automatically be checked on NR3. If a search of NR3 indicates a match with an applicant, the authority will seek further information about the entry on the register from the authority which recorded it. Any information received as a result of an NR3 search will only be used in respect of the specific license application and will not be retained beyond the determination of that application. This is a mandatory part of applying for and being granted, a hackney carriage / PHV driver licence. The authority has a published policy on the approach it will take requests by other authorities for further information about entries on NR3, and about the use it will make of any further information provided to it. Information will be processed in accordance with the Data Protection Act (DPA) and General Data Protection Regulation (GDPR). Any searches, provision or receipt of information of or under NR3 are necessary to the authority’s statutory licensing functions of ensuring that all drivers are fit and proper to hold the applicable licence. It is not intended that any NR3 data will be transferred out of the United Kingdom.
