Deprivation of Liberty Safeguards (DoLS)

Deprivation of Liberty Safeguards (DoLS) are part of the Mental Capacity Act 2005. They are designed to protect the rights of people aged 18 or over who lack capacity to consent to their care arrangements.

Care homes and hospitals must apply for a DoLS authorisation from the local authority and notify the CQC if it is approved.

Your rights under DoLS

Under a DoLS authorisation, you will always have a representative (family member, friend, or trained professional) to speak on your behalf.

You also have the right to:

  • Ask the Council for a review
  • Appeal the authorisation to the Court of Protection
