Who can make representations

Representations can be made by:

  • responsible authorities, such as the Police, Fire Service or Environmental Health
  • local residents or businesses who may be affected by the application

Representations must:

  • be made in writing within 28 days of the application being received
  • relate to one or more of the licensing objectives in the Gambling Act 2005:
    • preventing gambling from being a source of crime or disorder
    • ensuring gambling is conducted fairly and openly
    • protecting children and vulnerable people from harm or exploitation

How decisions are made

When considering applications, Trafford Council must have regard to its Statement of Gambling Principles, which sets out how the licensing objectives will be applied locally.

If there are no representations

If no representations are received within the 28-day period, your premises licence will be granted automatically.
You will receive confirmation and a copy of your licence.

If there are representations

If representations are received, your application will be reviewed by the Licensing Sub-Committee.

You will:

  • be notified of the date of the hearing
  • receive copies or summaries of the representations
  • have the opportunity to attend and speak at the hearing

The Sub-Committee will decide whether to:

  • grant the licence
  • grant the licence with conditions
  • refuse the application

You will be informed in writing of the outcome and reasons for the decision.

If your application is refused

If your application is refused, you have the right to appeal to the Magistrates’ Court within 21 days of receiving the decision notice.
