CIL – Revised Regulation 123 List

The Regulation 123 List sets out the types of infrastructure that may be funded by CIL in the Borough. The main purpose of the list is to provide transparency around what the Council intends to fund through CIL and what site specific infrastructure Section 106 contributions will continue to be used for. The intention is to ensure that there is no duplication in the use of both CIL and Section 106 for the same project.

It is considered, as originally drafted, the Regulation 123 List could be open to misinterpretation and it would therefore benefit from a review to clarify what infrastructure may be eligible for CIL funding. The points of clarification relate to the introductory text at the beginning of the Transport, Education and Sport/Recreational Facilities section, as well as the two ‘catch all’ points in the Education section.

The Revised Regulation 123 List has been published for a 6 week consultation from 27th June – 8th August 2016. A copy of the consultation document is available to download below, alongside an Explanatory Note setting out the details and reasons for the proposed changes.

Comments are invited on the specific changes made to the Regulation 123 List only. This consultation does not include the CIL Charging Schedule which has been approved following consultation, examination and relevant Council decisions.

Responses to the consultation should be emailed to strategic.planning@trafford.gov.uk or posted to Strategic Planning, Trafford Council, Trafford Town Hall, Talbot Road, Stretford M32 0TH.
