What information we collect

  • Tenancy and allocation records for allotments

  • Records of inspections, enforcement actions or prosecutions
  • Photographs, videos or site inspection notes

Some of this may include special category data, such as:

  • Health information if relevant to your service request or enforcement case
  • Criminal offence data for enforcement or prosecution purposes

Why we collect your information

We use your information to:

  • Provide and manage allotments and related services
  • Provide burial and cremation services
  • Deliver pest control services
  • Issue and manage parking permits, penalty charge notices and enforcement
  • Respond to complaints and service requests
  • Investigate and take enforcement action for breaches of environmental, trading and licensing laws
  • Carry out inspections and monitor compliance
  • Meet our legal duties under environmental health, public safety and related legislation

Our lawful basis

The main legal bases we use are:

  • Public task – to carry out our duties under environmental, trading and public protection laws
  • Legal obligation – to comply with statutory requirements for service delivery and enforcement
  • Contract – for services you have requested and paid for

For pest control, if you provide health information to help us adapt the service, we use your explicit consent (UK GDPR Article 9(2)(a)).

For special category and criminal offence data, we rely on:

  • Substantial public interest – under UK GDPR Article 9(2)(g) and Schedule 1 of the Data Protection Act 2018, for law enforcement and protecting the public

Who we share your information with

We may share your information with:

  • Other council departments, such as highways, legal services and finance
  • Government agencies, such as the Environment Agency or DEFRA
  • Police and other law enforcement agencies
  • Contractors and service providers delivering services on our behalf
  • Courts and tribunals, where required for enforcement action
  • Other local authorities, if a case or service involves them

How long we keep your information

Retention periods vary depending on the service:

  • Allotment tenancy records – six years after tenancy ends
  • Burial and cremation records – kept permanently for statutory purposes
  • Parking permit and enforcement records – six years after case closure
  • Pest control records – two years after service completion
  • Enforcement case files – kept in line with statutory requirements for the relevant legislation

Environmental and community services do not make decisions about you based solely on automated processing.
