Licensing service privacy notice
Read this alongside the Trafford Council privacy notice for information that applies to all services.
This page explains how we collect and use personal information in the Licensing Service.
What information we collect
We may collect:
- Name, address, date of birth and contact details
- Proof of identity, right to work and eligibility documents
- Criminal record information (Disclosure and Barring Service checks)
- Financial information where required for certain licence types
- Business and trade details, including company registration numbers
- Records of applications, inspections, enforcement actions and complaints
- Photographs for ID badges or records
This may include special category data such as:
- Health information (for certain licences)
- Criminal offence data (convictions, cautions, ongoing investigations)
Why we collect your information
We use your information to:
- Process and issue licences and permits under relevant laws
- Assess your suitability to hold a licence
- Carry out inspections and enforcement activity
- Investigate complaints or breaches of licence conditions
- Maintain public registers of licence holders (where required by law)
- Protect public safety and prevent crime
- Meet legal duties under licensing legislation, including:
- Licensing Act 2003
- Gambling Act 2005
- Taxi and private hire licensing laws
- Animal Welfare (Licensing of Activities Involving Animals) Regulations 2018
Our lawful basis
The main legal bases we use are:
- Public task – to carry out our duties under licensing legislation
- Legal obligation – to comply with statutory requirements for licensing
- Consent – where you provide optional information not required by law
For special category and criminal offence data, we rely on:
- Substantial public interest – under UK GDPR Article 9(2)(g) and Schedule 1 of the Data Protection Act 2018, for the purpose of preventing or detecting unlawful acts and protecting the public
Who we share your information with
We may share your information with:
- Other council departments, such as Environmental Health or Trading Standards
- Greater Manchester Police and other law enforcement agencies
- The Home Office (for immigration and right‑to‑work checks)
- HM Revenue & Customs (for tax compliance checks)
- Disclosure and Barring Service (for criminal record checks)
- Regulatory bodies relevant to the licence type
- Members of the public, where licensing law requires public registers
We only share what is necessary and will always do so securely.
How long we keep your information
We keep licensing records for six years after the licence has expired, been revoked or refused.
Some enforcement records may be kept longer where required by law.
Automated decision‑making
Licensing decisions may involve automated systems for initial eligibility checks.
These are always followed by human review before a final decision is made.
